On December 22, 2017, the Superior Court for the Third Judicial District of Alaska issued an order granting a summary judgment motion brought by Larson • King attorneys Mark Solheim, Stephen Laitinen and Kevin McCarthy, on behalf of the Firm’s clients. In that case, Plaintiffs alleged that they were exposed to chemicals at a construction work site and filed a multi-million dollar lawsuit against the Firm’s clients. The defense team filed three separate summary judgment motions on behalf of the clients. After briefing and oral argument, the Superior Court issued a 23-page ruling, and granted the first motion, premised on Alaska’s Workers’ Compensation Exclusivity statute, which effectively precluded all of Plaintiffs’ legal claims. As a result, the Superior Court dismissed Plaintiffs’ lawsuit in its entirety.
